EXPENSES CHARGED TO THE BUYER

In case of agreement, taxes and capital expenditure, VAT, notary and register must be paid by the buyer.

MEDIATION EXPENSES CHARGED TO BOTH PARTIES (SELLER AND BUYER)

Reimbursement of expenses: "Unless pacts or use against, the broker is entitled to reimbursement of expenses in respect to the party on whose behalf they were performed even if the affair has not been
concluded". Art. 1756 of the Civil Code.
Commission: "The Mediator is entitled to a commission from each party, if the transaction is concluded as a result of his intervention".
Art. 1755 CC: Commissions must be agreed between the parties according to usage.

GENERAL HOLIDAY RENT CONDITIONS

LAW

The property in question is leased exclusively to meet the housing needs of tourists, according to Article 1, paragraph 2, letter C of the Law 431/98, and exclusively subject to the rules laid down in Art. 1571 to 1614 of the Civil Code. Any other destination of the leased property is expressly excluded. The duration of the lease, unless otherwise indicated, will last up to 30 (thirty) days. The landlord and the tenant shall permit each other to divulge personal information in connection with matters relating to the tenancy (Law 31 December 1996, n. 675, Privacy Act). For matters not covered in this paper, the parties make express reference to the provisions of the Civil Code and in any case the current rules and local customs.

RESPONSIBILITY

For all stays in this catalog, the Real Estate "Your home by the sea" is acting solely as an intermediary between the guests and property owners, therefore, not assuming any obligation on its own. The apartments and villas have been visited and checked. All descriptions are therefore corresponding to reality and made in good faith, but we assume no liability for changes or variations that may have been introduced by the owners without informing us. In case of complaints the customer is asked to make immediate contact with our sales office, confirming in writing any objections within 24 hours. Any later claim shall operate as a simple warning.
Any disputes by the court of Livorno.

PRICES

Prices include VAT, tourist tax and the compensation for the agency. Include the consumption of electricity, gas, water. DO NOT include linen. DO NOT include the final cleaning. DO NOT include the deposit. DO NOT include any costs for animals. These costs will vary depending on the apartment chosen, the size or time of year. There are no admission fees.

PAYMENTS AND CANCELLATIONS

Reservations must be accompanied by a deposit equal to 30% of the total. The balance will be paid before arrival at the agency, at the latest at delivery of the keys. The deposit will not be refunded in case of cancellation. No refund will be due to those who decide to terminate in advance a holiday already begun.

DELIVERY

The buildings will be delivered, furnished and equipped with kitchenware, between the hours of 15:00 and 20:00 on the day of arrival, and must be returned by 10:00 on the day of termination of the rental.

ACCOMMODATION

The apartments are equipped with dishes and kitchen items. They are not equipped with linen and towels. It is not allowed to occupy the apartment to a number of people than exceeds the number of beds indicated on the rental agreement, on pain of termination. The tenant may not sublease or loan, in whole or in part, the property unit, on pain of termination.

DEPOSIT

Any damage caused to the property must be paid. To this end, the customer, at the delivery of the keys, must pay a deposit which varies depending on the type of property: EUR 200.00 for studios and apartments, € 400.00 for three and four bedrooms and € 500.00 for villas.
This amount will be entirely refunded at the end of the stay, after checking the condition of the property and its equipment. In case of damage to equipment and / or to the property, only the balance between deposit and damage will be refunded. If the damage exceeds the amount of deposit paid, the tenant must pay the Agency the relative excess. In case of departure outside office hours the deposit will be refunded within seven days after departure.

FINAL CLEANING

For the final cleaning of the property an amount will be charged that varies depending on the type of apartment, as reported in the descriptions of individual objects. Final cleaning fee does not include the kitchen area and dishes, which must therefore be left by the customer perfectly clean. Missing or incomplete cleaning will be charged € 20. In case of complaints about the initial cleaning, the same must reach the Agency no later than 12.00 noon on the day after arrival.

ANIMALS

Pets are not allowed in the property unless prior arrangements with the agency.

DUTY OF CARE

The Agency is required to assist its host according to professional standards of care, only with reference to its obligations as required by law or contract. The Agency is not liable for the obligations of the owner to the tenant.

LEASE

Leases of property are governed by the law n. 431/1998 (residential) and n.392/1978 (commercial).
All leases and rental contracts of immovable property of any amount, are subject to registration with the Revenue Agency, provided that they last more than 30 days a year. (L. 449/97, Art. Co.18 21). The payment of the registration tax is for the landlord and the tenant in equal shares, and they are jointly liable for the payment of the whole tax.

OBLIGATIONS OF THE OWNER

The landlord has the obligation to deliver the property in good conditions, no defects, and to maintain it to serve the agreed use during the lease. The landlord must perform, during the lease, all repairs necessary, except for minor maintenance, charged to the tenant. (Section 1575 et seq. of the Civil Code).

OBLIGATIONS OF TENANT

The tenant has the obligation to take delivery of the property and use it with diligence. He must execute in a timely manner all the works of necessary routine maintenance, and repair any damage caused by him.
The tenant must pay the rental within the agreed time. It also has an obligation to return the rented property in the same state in which it was received, save the deterioration of use. The tenant is required to return the keys at the expiration of the lease, providing for the repair of damage eventually caused. (Section 1587 et seq of the Civil Code).

MEDIATION FEE

The commission due to the mediator in the lease of real property for a period of one or more years shall be computed as a percentage on the annual rental fee and paid by both parties according to usage.

RENTAL OF A BUSINESS

The rules for the rental of a business are defined in Art. 2562 Civil Code, which refer to Art. 2561 governing the usufruct of a company. In particular, under the second paragraph of Art. 2556 cc, the contract must be drawn up by public deed and must be deposited with the Registry of Companies by the notary within thirty days from the contract’s stipulation, to third parties knowledge.

MEDIATION FEE

The commission due to the mediator in the lease of a business shall be computed and paid by both parties according to usage.
